Q. Is it legal to ride my ATV in town and surrounding areas?

A. Just a guess: Anywhere between 80 in the day and 60-50 at night.

Q. Is my kazuma mammoth 800 legal for the trails?
A. "Side by side utility vehicles which have been approved by the Board of Directors for use upon the Hatfield McCoy Trail System shall be subject to all of the safety rules and regulations of the Authority and shall also be subject to the following safety rules specifically applying to side by side utility vehicles:
1. Side by side utility vehicles shall only be operated on green trails only.
2. All manufacturer installed seat belts shall be in good working order.
3. The number of passengers carried on a side by side utility vehicle shall be limited by the number of manufacturer seat belts.
4. All participants must abide by all of the manufacturer’s requirements regarding the age and size of operators and passengers.
5. No passenger that is too small to reach and hold any manufacturer installed handgrip shall be allowed on a side by side utility vehicle.
6. Operation of a side by side utility vehicle is prohibited by anyone under the age of sixteen (16) years of age.
7. Any operator of a side by side utility vehicle must possess a valid driver’s license.
8. The driver and passenger of a side by side utility vehicle must wear seat belts at all times.
9. The driver and passengers of a side by side utility vehicle shall keep their hands, arms, feet and legs inside the vehicle at all times during operation.
10. The side by side machine approved to be operated on the Hatfield-McCoy Trails are as follows:
• Arctic Cat Prowler
• Kawasaki Mule
• Kawasaki Teryx
• Kubota RTV
• Polaris Ranger
• Polaris Razor
• Suzuki QUV
• Yamaha Rhino"

A. I am unable to speak on behalf of the town, however, I personally feel very safe saying that if the manufacturer states directly that an ATV is safe to carry two people, you would have nothing to worry about.

A. Pat Garland, owner of the Historic Matewan House Bed & Breakfast, provides a small shuttle bus tour around the town and also to a site in Pike County, KY (site of the Pawpaw Tree Incident). You can find that phone number and webaddress here. I would highly suggest calling him. He would probably be able to provide the most information to you. While in town, I would also suggest visit Donna May at the Matewan Depot Restaurant -- she has a wealth of knowledge on the subject and is quite entertaining to be around.

Q. Do any of the trails close during winter months?
A. No. The trails are open for riding year-round. The trail offices, however, do close for holidays. Certain trails might close from time to time for maintenance, also.

Q. Is it legal to ride my ATV in town and surrounding areas?
A. Yes, it is legal if you follow the safety regulations set forth the following town Ordinance:
ORDINANCE
PROVIDING A POLICY REGARDING THE USE OF ALL TERRAIN RECREATIONAL VEHICLES WITHIN THE TOWN LIMITS

WHEREAS, the Town resolved to promote tourism and recreation in the Town of Matewan, and

WHEREAS, the Town desires to continue to promote tourism and recreation activities in the area because of the community benefit it provides as well as the positive economic impact it has in our community; and

WHEREAS, one of the recreational activities enjoyed in the area is the use of All Terrain Vehicles (ATV's) for joy riding and sight seeing on surrounding trails developed and undeveloped in the area; and

WHEREAS, the Town has many residents that, in addition to tourists and visitors, own and use ATV's for recreation; and

WHEREAS, the Town desires to increase the number of visitors to the area and the length of time that visitors stay in the area, and in addition, encourage the use of Town businesses; and

WHEREAS, the Town desires to make the use of ATV's for recreation more convenient for the city residents as well as visitors to the area; and

WHEREAS, Federal and State law gives the Town the option to do the same; and

WHEREAS, other Towns within the State have done the same and have had positive results.

NOW, THEREFORE, IT IS HEREBY RESOLVED AND ADOPTED BY THE TOWN OF MATEWAN AS FOLLOWS:

1. That an ATV is allowed to be driven on streets within Town limits under the following conditions or restrictions:
a) The ATV is legally licensed and registered with the Hatfield-McCoy Trail System.
b) The driver of an ATV must be over the age of sixteen and must hold a valid driver's license. No person under the age of sixteen shall be allowed to operate an ATV within the town limits.
c) The ATV driver obeys all state and city traffic laws and local town ordinances.
d) The ATV is in a safe running condition with only one person on each ATV.
e) The ATV is being operated in a safe condition.
f) The ATV is not driven down any street within city limits that borders school ground while school is in session.
g) The ATV, when driven at night, must have working head and tail lights.
h) The ATV driver, when driving on streets within Town limits, must be going to or from Town services, a local Town business, or a legal riding area.
i) All riders must comply with rules and regulations promulgated by Hatfield-McCoy Regional Recreational Authority.
j) Riders must wear the same safety equipment in Town as required on the trails.

2. The streets within the Town limits upon which all ATV drivers shall use are as follows:
The entire downtown business district everyday following the established route for entering and exiting downtown.

3. The Town Police Department or other legal policing authority is given all rights to write citations to those individuals breaking laws or safety guidelines as outlines in this Ordinance. The Chief of Police will meet with the County Sheriff to educate his department regarding the ATV regulations outlined herein.
